Loss resulting from damage or injury

It is possible to become a victim of an accident resulting in damage and/or injury anywhere, either in the workplace, at home or in the street.

Personal injury is the general category covering all personal injury cases. Personal injury laws cover not only car accidents, accidents in the workplace, product liability and medical malpractice, but also dogbites, animal attacks, construction accidents, and premises liability.

The purpose of the personal injury system is to allow the injured person to be compensated financially or “made whole” after they have suffered harm due to someone else’s carelessness or intent.

Liability

In the Netherlands it is arranged that – if the other party is liable and has liability coverage – you can request compensation from the other party’s insurance company for all losses stemming from the accident or incident.

For example, you can ask compensation for the following loss items:

  • enabling help with the household, shopping, bringing children to school etc.;
  • medical expenses;
  • loss of earning capacity if you can no longer work either wholly or partially due to bodily injury;
  • damages for lost pension benefits;
  • academic delay;
  • costs associated with admission to a hospital or rehabilitation centre;
  • travel expenses.

Non-material damages

In general you can also get compensation for non-material damages (damages for emotional distress). Such compensation, in Dutch called ‘smartengeld’, is designed to compensate you for the psychological impact your injury has had on your daily life.

The expenses for a lawyer are usually covered by insurance.
