Loss resulting from damage or injury

Anywhere, either on the work floor, at home or out on the street, it is possible to become a victim of an accident resulting in damage and/or injury.

Personal injury is the general category under which all personal injury cases fall. Personal injury laws cover not only car accidents, accidents on the workfloor, product liability and medical malpractice, but also for example dog bites, animal attacks, construction accidents, and premises liability.

The purpose of the personal injury system is to allow the injured person to be compensated financially or “made whole” after he or she has suffered harm due to someone else’s carelessness or intentional conduct.

Liability

In the Netherlands it is arranged that – if the other party is liable and has liability coverage – you can request compensation from the other party’s insurance company for all losses stemming from the accident or incident.

For example, you can ask compensation for the following loss items:

  • enabling help with the household, shopping, bringing children to school etc.;
  • medical expenses;
  • loss of earning capacity if you can no longer (fully) )work due to your bodily injury;
  • damages for lost pension benefits;
  • academic delay;
  • costs associated with admission to a hospital or rehabilitation center;
  • travel expenses.

Non-material damages

In general you can also get compensation for non-material damages (emotional damages). Such compensation, in Dutch called “smartegeld”, is designed to compensate you for the psychological impact your injury has had on your daily life.

The expenses for a lawyer are usually covered by insurance.
